Darryl Humphrey Sr.

Kendleton Mayor Darryl Humphrey Sr. was re-indicted on April 1 in connection with an alleged open records act violation and abuse of office.

Humphrey was criminally indicted in December 2022 for failing to comply with a public records request, and indicted in August 2023 on one count of abuse of official capacity — a Class A misdemeanor.

He was re-indicted April 1 on both charges and the new indictments includes the allegation of “official misconduct.”

Humphrey is accused of using the powers of his office to illegally raise the water rates of a Kendleton business from around $100 per month to $700 per month. The businessman filed a Texas Public Information Act request for documents pertaining to the rate increase but he said Humphrey refused to provide them as required by state law.

A Class A misdemeanor is punishable by up to 1 year in jail and a $4,000 fine.

Failing to comply with a public records under the Texas Public Information Act is a Class B misdemeanor punishable by up to six months in jail and a $2,000 fine.

Both offenses involve a public official and thus they require a grand jury to agree to a criminal indictment.
